Flaws in the Efficiency Gap

چکیده
Gerrymandering is returning to the Supreme Court. For the first time in three decades, a federal court invalidated redistricting legislation on the grounds that it constituted a partisan gerrymander in violation of the Fourteenth Amendment. That court relied, in part, on a new tool—the efficiency gap—which some have touted as the means to “end gerrymandering once and for all.” We evaluate this tool and find it wanting. The efficiency gap is neither a cure to the malady of partisan gerrymandering nor even a good idea. Its use by courts may worsen the problem they seek to solve. The foundation for partisan gerrymandering claims is the 1986 case of Davis v. Bandemer, in which a fractured Supreme Court held that partisan gerrymandering is justiciable as a violation of the Equal Protection Clause of the Fourteenth Amendment because it is an attempt to weaken the voting power of a disfavored political party. The ruling has been repeated in every Supreme Court case on partisan gerrymandering since, despite a minority view that partisan gerrymandering should be held to be a political question. However, while these cases have opened the door to challenges, neither Bandemer nor any of the subsequent cases rejected any districting laws as constituting an illegal partisan gerrymander.

Impact of Energy Subsidies Elimination on Technology Gap Ratio in Cucumber Production
This paper presents an analysis of technical efficiency and technology gap ratio (TGR) in greenhouse cucumber in Fars Province, Iran. Cucumber production was chosen for this study for the reason that greenhouse productions in this provincemainly have focused on this product. The data used in this study was obtained from a random sample of 127 greenhouses in Fars Province for 2010 to 2011. Metaf...
متن کاملMeasuring technological gap ratio of wheat production using StoNED approach to metafrontier
The aim of this paper is to use the concept of the metafrontier function to study the determination of efficiency differentials and Technological Gap Ratio (TGR) on wheat production in Khorasan Razavi province. In this study, we used the metafrontier function and group frontier based on the concept of Stochastic Nonparametric Envelopment of Data analysis (StoNED). The data used in this stud...
متن کاملNetwork Data Envelopment Analysis Models For Measuring Efficiency Of a Four-Stage Supply Chain With Returned Outputs
In this paper using DEA technique, four-stage DEA model mooted in order to consider the situation in which returned products exist. Returned products are the inputs of the previous sub-processes that need to be reprocessed due to existence of flaws. Here, a supply chain with four stages as supplier, manufacture, distributor, and retailer with intermediate and return products has been considered...
متن کاملNumerical study of the effect of the tip gap size and using a single circumferential groove on the performance of a multistage compressor
The effect of the tip gap size on the performance of a multistage axial compressor was studied by means of computational fluid dynamics (CFD). It was found that the performance of the compressor was very sensitive to the size of the tip gap. By increasing the gap size, the stall margin value, the total pressure ratio and the compressor efficiency reduced considerably. The flow field at the tip ...
متن کاملUtilizing Monte Carlo Method for Ranking Extreme Efficient Units in Data Envelopment Analysis
Data envelopment analysis (DEA) is a mathematical programming method for calculatingefficiency of decision making units (DMU). In calculating the efficiency score of unitsthrough DEA we may come up with some efficient units. But the question is among theseefficient units which of them is better. As we know, it is possible to rank inefficient unitsthrough efficiency score; however, for ranking e...
